The Commercial Court of Dakar ruled in favor of the real estate company SCI NSAR in the dispute with the company Polyethylene Senegal SARL, a company specialized in plastic transformation and the production of films, bags, and industrial packaging.<\/p>\n

At the heart of the dispute was a debt that SCI NSAR was seeking to recover. To protect its rights, the real estate company had obtained a conservatory mortgage on a property owned by its presumed debtor, pending a decision on the merits.<\/p>\n

In its judgment rendered on June 3, 2026, the court declared the action admissible before ruling in favor of SCI NSAR. The court thus ordered Polyethylene Senegal SARL to pay the sum of 830,661,000 FCFA to the plaintiff as the principal amount of the debt, plus interest from June 19, 2023.<\/p>\n

The court also ordered the validation of the conservatory mortgage registered on the property in question. This guarantee concerns land title No. 3975\/DG, recorded in the land register of Grand Dakar under number 10,936\/GR. This measure strengthens the possibilities of recovering the debt recognized by the court.<\/p>\n

This decision represents a major legal victory for SCI NSAR, which not only obtains recognition of its debt but also maintains an immovable security to ensure payment. For Polyethylene Senegal, a historical player in the plastics sector in Senegal, the judgment marks a new phase of the case, either through the execution of the decision or through the possible exercise of legal remedies.<\/p>\n

In any case, this case once again illustrates the importance of security mechanisms in large-scale commercial disputes, where the preservation of the debtor’s assets is often a central issue for creditors.<\/p>\n
