Meanwhile, German courts are issuing baseless verdicts against US patents, allowing German companies to skip payments meant for US taxpayers.\u00a0<span class=\"xn-location\">Germany&#8217;s<\/span>\u00a0judicial rulings mirror\u00a0<span class=\"xn-location\">China&#8217;s<\/span>\u00a0current behavior towards American inventors.<\/i><\/p>\n<p>A recent decision made by\u00a0<span class=\"xn-location\">Germany&#8217;s<\/span>\u00a0Supreme Court raises the question of whether German courts are biased against non-German companies, particularly against American companies.<\/p>\n<p>Enovsys is a US-based company, and even though many are unaware, its Location Services and Privacy technology are widely used by most mobile devices today. This technology was created by Enovsys&#8217; founder\u00a0<span class=\"xn-person\">Mundi Fomukong<\/span>\u00a0&#8211; an African American serial inventor from\u00a0<span class=\"xn-location\">California<\/span>\u00a0&#8211; in the mid-&#8217;90s when phones were the size of a toaster.<\/p>\n<p>Enovsys&#8217; technology positions a call receiver within a wireless network and permits authorized third-party applications to access the position of a subscriber&#8217;s call receiver only after consent has been established. Everyone has seen it, and everyone uses it.<\/p>\n<p><u><a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=2922126-1&amp;h=51835028&amp;u=https%3A%2F%2Fworldwide.espacenet.com%2FpublicationDetails%2ForiginalDocument%3FCC%3DEP%26NR%3D1133827B1%26KC%3DB1%26FT%3DD%26ND%3D4%26date%3D20061227%26DB%3DEPODOC%26locale%3Den_EP&amp;a=Patents+for+the+invention\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Patents for the invention<\/a><\/u>\u00a0were obtained in the US,\u00a0<span class=\"xn-location\">Europe<\/span>,\u00a0<span class=\"xn-location\">Canada<\/span>,\u00a0<span class=\"xn-location\">China<\/span>,\u00a0<span class=\"xn-location\">Japan<\/span>, and Singapore.<\/p>\n<p>In an earlier\u00a0<u><a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=2922126-1&amp;h=2507917682&amp;u=https%3A%2F%2Fcaselaw.findlaw.com%2Fus-federal-circuit%2F1533724.html&amp;a=US+case%2C+Sprint+licensed+Enovsys%27\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">US case, Sprint licensed Enovsys&#8217;<\/a><\/u>\u00a0patent\u00a0<b>only after it was sued<\/b>\u00a0for violating a similar US patent and failed to reverse the jury&#8217;s verdict afterward in the US Court of Appeals.<\/p>\n<p><span class=\"xn-location\">Germany&#8217;s<\/span>\u00a0largest telecommunication company,\u00a0<u><a href=\"https:\/\/c212.net\/c\/link\/?t=0&amp;l=en&amp;o=2922126-1&amp;h=180195973&amp;u=https%3A%2F%2Fwww.telekom.com%2Fen&amp;a=Deutsche+Telekom\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Deutsche Telekom<\/a><\/u>\u00a0(DT), violated Enovsys&#8217; patent, and Enovsys sued for patent infringement in\u00a0<span class=\"xn-location\">Germany<\/span>. After nine long years of litigation, the case reached the German Supreme Court for the second time. However,\u00a0<span class=\"xn-location\">Germany&#8217;s<\/span>\u00a0Supreme Court eventually ruled that Enovsys&#8217; patent in\u00a0<span class=\"xn-location\">Germany<\/span>\u00a0was not enforceable, claiming that its patent was &#8220;obvious&#8221; and, therefore, not patentable. In reaching this decision, the Supreme Court created its own theory to advance an obviousness case in favor of one of the largest and most powerful companies in\u00a0<span class=\"xn-location\">Germany<\/span>, even though DT had not raised this defense at any point in the nine years of litigation.<\/p>\n<p>This German case demonstrates the power wielded by large multi-national government-owned corporations, primarily when litigating against foreign entities on their home turf.<\/p>\n<p>Recently, Deutsche Telekom expanded into the US with a 43 percent share of the telecommunications company T-Mobile.<\/p>\n<p>US Congress has several bills pending that would help US inventors protect their rights, including the Inventor Rights Act, which would make it easier for inventors to enjoin the unauthorized use of their patent rights.<\/p>\n<p>According to Enovsys executive and patent holder\u00a0<span class=\"xn-person\">Mundi Fomukong<\/span>, &#8220;Every time DT fell short in its pleadings, German courts consistently formulated a decision, divorced from the pleadings, to absolve DT of its responsibility\u2026 Even though a full reasoning from the Supreme Court is pending, the obviousness theory concocted during trial appears to be meritless and certainly a violation of due process.
